These Terms and Conditions (hereinafter referred to as "Terms") govern the mutual rights and obligations between Grownal s.r.o., with its registered office at Zbraslavská 12/11, Malá Chuchle, 159 00 Praha, Czech Republic, ID No. (IČO): 23512059, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 428418 (hereinafter referred to as "Provider", "we", or "us") and the users of the mobile application Grownal (hereinafter referred to as "User" or "you").

By downloading the Grownal application from the Apple App Store, creating a user account, or using the Service, you express your unconditional agreement to these Terms. If you do not agree to these Terms, you must stop using the application and uninstall it immediately.

I. INTRODUCTION AND SERVICE DESCRIPTION

1.1. The Grownal Service. The Grownal application is a personal development tool combining features of a digital journal, dream diary, and text analysis using artificial intelligence (AI). The Service includes a virtual AI coach named "Lumo," which provides feedback and insights based on user data.

1.2. Digital Content & Right of Withdrawal. The application is provided as digital content. By downloading the application and/or purchasing a subscription, you expressly consent to the immediate performance of the contract (i.e., making the content and features available to you). You acknowledge that by giving this consent, you lose your right of withdrawal from the contract within the statutory 14-day period once the performance has begun.

1.3. Relationship with Apple. These Terms are concluded between you and the Provider only, not with Apple Inc. The Provider, not Apple, is solely responsible for the Grownal application and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

II. AGE LIMITATION AND ELIGIBILITY

2.1. Minimum Age. The Services of the Grownal application are intended exclusively for persons 13 years of age or older. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you declare that you have reviewed these Terms with your parent or legal guardian and that you both agree to them.

2.2. Prohibition for Children. Use of the application by persons under the age of 13 is strictly prohibited. If we discover that an account belongs to a person under the age of 13, it will be immediately terminated, and all data associated with it will be deleted.

III. MEDICAL AND AI DISCLAIMER (IMPORTANT)

3.1. Not Medical Advice. The Grownal application, the AI coach Lumo, and dream analyses do not constitute and do not replace professional medical advice, diagnosis, or treatment. The content generated by the application is for informational, self-improvement, and entertainment purposes only. The Provider is not a licensed healthcare provider.

3.2. Crisis Situations. If you suffer from psychological problems, severe depression, anxiety, or have suicidal thoughts, do not use this application as a solution. Immediately seek professional help or contact emergency services. The Provider bears no responsibility for any decisions or actions you take based on information obtained from the application.

3.3. AI Hallucinations and Accuracy. You acknowledge that the features "Lumo," "AI Insights," and "Dream Analysis" utilize Large Language Model (LLM) technology. This technology is experimental and may generate information that is inaccurate, misleading, factually incorrect, or irrelevant (so-called "hallucinations"). The Provider does not guarantee the accuracy, completeness, or usefulness of AI outputs. Dream interpretation is based on symbolism and has no scientific basis.

IV. SUBSCRIPTION, PAYMENTS, AND TRIAL

4.1. In-App Purchases. The application offers a basic free version ("Free") and a paid version ("Premium"). All payments for Premium subscriptions are processed exclusively through your Apple ID account in the Apple App Store.

4.2. Pricing and Renewal. Subscription prices are displayed in the application at the time of purchase. Subscriptions automatically renew unless you turn off auto-renew in your Apple ID settings at least 24 hours before the end of the current period.

4.3. Free Trial. If a free trial period (e.g., 7 days) is offered, you will be automatically charged for the annual or monthly subscription upon its expiration unless you cancel the subscription at least 24 hours before the trial period ends.

4.4. Cancellation and Refunds. Grownal s.r.o. does not have access to your payment details and cannot process direct refunds. All refund requests must be directed to Apple Support according to their terms and conditions. Cancellation of a subscription will take effect after the current prepaid period ends.

V. USER CONTENT AND INTELLECTUAL PROPERTY

5.1. Content Ownership. You retain exclusive ownership of all text, dream records, notes, and data you enter into the application ("User Content"). Grownal s.r.o. does not claim ownership rights to your thoughts or entries.

5.2. License to Operate. By entering content into the application, you grant the Provider a worldwide, non-exclusive, royalty-free license to use this content solely for the purpose of providing and improving the Service. This includes the right to store your text on our servers, back it up, and process it via AI algorithms (Lumo) to generate your personal insights.

5.3. Privacy. We do not sell your private data to third parties for marketing purposes. AI processing is automated. Detailed information on personal data handling can be found in our Privacy Policy.

VI. SECURITY AND LIMITATION OF DATA LIABILITY

6.1. Encryption. The security of your data is our priority. We use modern technological security standards, including data transmission encryption (SSL/TLS) and encryption-at-rest, to protect your private entries from unauthorized access.

6.2. Security Limitations. You acknowledge that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your User Content, Grownal s.r.o. cannot guarantee its absolute security.

6.3. Data Breach Liability. The Provider shall not be liable for any leakage, loss, or misuse of user data caused by:

a) Force majeure, hacking attacks, or cyber-attacks that could not be prevented by standard security measures;
b) Compromise of the User's password or insufficient security of the User's device (e.g., loss of phone, weak Apple ID password);
c) Failure of third-party services (e.g., cloud providers) beyond our direct control.

VII. USER CONDUCT AND TERMINATION

7.1. Prohibited Activities. You agree not to use the application to upload content that is illegal, promotes violence, terrorism, child pornography, or hate speech. You must not attempt to reverse engineer the application, access the source code, bypass security measures, or use the application to train other artificial intelligence models.

7.2. Termination. The Provider reserves the right to immediately suspend or terminate your account without notice or liability if you breach these Terms.

VIII. LIMITATION OF LIABILITY

8.1. "AS IS" and "AS AVAILABLE". The Application is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. The Provider does not warrant that the application will function uninterrupted, error-free, or meet all your expectations.

8.2. Liability Cap. To the maximum extent permitted by applicable law, Grownal s.r.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages. The Provider's total liability for any claims arising out of or relating to these Terms or the use of the Application is limited to the amount you paid us to use the Service in the last 12 months.

IX. FINAL PROVISIONS AND GOVERNING LAW

9.1. Governing Law. These Terms and the relationship between you and the Provider shall be governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., Civil Code. Any disputes shall be resolved by the competent courts in the Czech Republic.

9.2. Consumer Dispute Resolution. In the event of a consumer dispute that cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court settlement to the designated body, which is the Czech Trade Inspection Authority (www.coi.cz).

9.3. Changes to Terms. The Provider reserves the right to modify these Terms at any time. We will notify you of significant changes via the application or email. Your continued use of the Service after the effective date of such changes constitutes your acceptance of the new Terms.

9.5. International Users.

EU Consumers: If you are a consumer residing in the European Union, nothing in these Terms deprives you of the protection afforded to you by mandatory provisions of the laws of your country of habitual residence.
US Users (Class Action Waiver): If you are a user in the United States, you agree that any disputes will be resolved on an individual basis. You hereby waive your right to participate in a class action lawsuit or class-wide arbitration to the fullest extent permitted by applicable law.
